Terms of Service
These Terms of Service ("Terms") govern your access to and use of Sharpingknives (the "App" or the "Service"), a self-hosted social media scheduling and publishing tool operated by Mario Gabriele Sabbatini, trading as Sharpingknives, Italy ("we", "us", "our", the "Operator"). Sharpingknives runs at postiz.sharpingknives.com and is deployed from the open-source Postiz software.
1. Acceptance of these Terms
By creating an account on the Service, signing in, or otherwise accessing or using the Service, you ("you", "the user") confirm that you have read, understood and agree to be bound by these Terms and by the Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
2. Description of the Service
The Service is a web-based social media scheduling and publishing application. It allows authenticated users to:
- Connect accounts they own on supported third-party platforms (including but not limited to TikTok, Instagram, Facebook, YouTube, X, LinkedIn, Threads, Pinterest, Reddit, Mastodon, Discord and Bluesky).
- Compose, schedule and publish text, image and video content to those connected accounts via the official APIs of each platform.
- Retrieve aggregated analytics that the platforms expose for the connected accounts.
The Service is provided as a software interface to those third-party platforms. The Operator does not own, control, or endorse content published through the Service.
3. Eligibility and user accounts
- You must be at least 16 years old (or the higher age of digital consent in your jurisdiction) to use the Service.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You agree to provide accurate information at registration and to keep it up to date.
- You may not impersonate any person or entity, or misrepresent your affiliation with any person or entity.
4. Your content
You retain all ownership rights to the content you upload, compose, schedule or publish through the Service ("Your Content"). You represent and warrant that:
- You own, or have all necessary rights, licences and permissions in, Your Content; and
- Your Content does not infringe the intellectual property, privacy, publicity or other rights of any third party.
By using the Service to publish Your Content to a third-party platform, you grant the Service the limited technical licence necessary to host, store and transmit Your Content to that platform on your behalf.
5. Third-party platforms and integrations
The Service publishes to and retrieves data from external platforms via their official APIs. By connecting any third-party platform to the Service, you also agree to comply with that platform's own terms of service, community guidelines, and acceptable use policies, including but not limited to:
- TikTok — Terms of Service and Community Guidelines.
- Meta — Instagram & Facebook — Meta Terms of Service and Community Standards.
- YouTube / Google — by connecting a YouTube channel, you agree to the YouTube Terms of Service and acknowledge that the Service's use of Google APIs is subject to the Google API Services User Data Policy.
- Each other platform you connect — its own respective terms.
The Service acts solely as a client interface to those APIs. We are not responsible for any decision a third-party platform makes regarding your account, including suspension, content removal, rate limiting, or changes to platform features. If a third-party platform changes or discontinues an API we rely on, the corresponding feature of the Service may become unavailable.
6. Acceptable use (prohibited activities)
You agree NOT to use the Service to:
- Publish, distribute or store content that is unlawful, defamatory, harassing, hateful, threatening, fraudulent, deceptive, sexually explicit involving minors, or otherwise objectionable, or that violates the Community Guidelines of any connected platform.
- Publish content to accounts you do not own or are not authorised to operate.
- Engage in spam, mass-automated posting beyond what the connected platform's terms allow, artificial amplification, fake engagement, or coordinated inauthentic behaviour.
- Scrape, harvest or otherwise collect data about other users of any connected platform.
- Reverse engineer, decompile or attempt to derive the source code of the Service except to the extent expressly permitted by applicable law and by the open-source licence of the underlying Postiz software.
- Probe, scan or test the vulnerability of the Service, or circumvent any security or authentication measure.
- Use the Service in any manner that could damage, disable, overburden or impair its operation.
- Use the Service to violate any applicable law, regulation or third-party right.
Violation of this section may result in immediate suspension or termination of your account, and we may report the violation to the relevant platform or authority.
7. Intellectual property
The Service is built on top of the open-source Postiz software, licensed by its authors under its own licence. The Operator retains all rights in any customisations, configurations and branding specific to this deployment. Nothing in these Terms transfers ownership of the Service to you; you receive only a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.
8. Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, availability, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that scheduled posts will always be delivered, or that data returned by third-party APIs (including analytics) will be accurate.
9. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall the Operator be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenues, data, goodwill or other intangible losses, arising out of or relating to your use of, or inability to use, the Service. Our aggregate liability for any direct damages arising out of or relating to the Service shall not exceed one hundred euros (EUR 100).
10. Indemnification
You agree to indemnify and hold harmless the Operator from and against any claim, demand, liability, damage, loss or expense (including reasonable legal fees) arising out of: (a) Your Content; (b) your use of the Service; (c) your breach of these Terms; or (d) your violation of any law or third-party right, including a third-party platform's terms of service.
11. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms, if your use creates a legal or security risk to the Service or to other users, or if we are required to do so by applicable law. You may stop using the Service at any time and may delete your account from the dashboard. Upon termination, your account data will be removed in accordance with the retention rules described in the Privacy Policy.
12. Changes to the Service and to these Terms
We may modify, suspend, or discontinue any feature of the Service at any time. We may update these Terms from time to time. When changes are material, we will revise the "Last updated" date at the top of this page and, where feasible, notify users through the Service. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
13. Governing law and jurisdiction
These Terms, and any dispute arising out of or in connection with them or the use of the Service, are governed by the laws of the Italian Republic, without regard to its conflict-of-laws rules. Subject to mandatory consumer-protection rules that may grant a different jurisdiction to the user, the courts of Italy shall have exclusive jurisdiction over any such dispute.
14. Miscellaneous
- If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Failure to enforce any right under these Terms shall not constitute a waiver of that right.
- These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Operator regarding the Service.
